I think an example ships with construct - from constructs home/start page search for zoom.

it is rarely a good idea to mix the physics behaviour with others.

you could also look at the relative x (&y) coordinates of the two colliding sprites and make a decision on these

How about you select everything (perhaps within a certain range of the player ?) and just step through each of these (including the player) and z order them ?
I will have a quick test and see if it works...
